U.S. Justice Department Appeals Dismissal of Chinese Illegal Agent Lawsuit

Steven Wynn, who served as the finance chairman of the Republican National Committee, allegedly joined with Broidy and others to lobby former U.S. President Trump and illegally deport Miles Guo in 2017. Wynn reportedly hand-delivered a letter from the Chinese Communist Party (CCP) to President Trump urging him to deport Miles.

The DOJ formally sued Wynn in court in May 2022 for allegedly acting as an illegal agent of the CCP, requiring Wynn to register under the Foreign Agents Registration Act (FARA), but Wynn’s attorneys denied that he had ever been an agent of the CCP. On October 12th, a federal court in Washington, D.C., dismissed the DOJ’s case against Wynn. A federal judge said that Wynn could not be required to register as a foreign agent because the relationship between Wynn and the CCP ended in 2017. But the judge also said that the DOJ could criminally sanction Wynn for his previously undisclosed lobbying practices during the statute of limitations period. The latest reports on December 9th indicate that the U.S. DOJ will re-appeal the lawsuit, which a federal court dismissed. “The Attorney General of the United States of America hereby appeals to the United States Court of Appeals for the District of Columbia from the judgment of this Court entered on the 12th day of October 2022, granting Defendant’s Motion to Dismiss,” the Justice Department said in a filing on Friday.
