Miles Guo Initiates Motion for Relief of Chapter 11 Trustee Luc A. Despins

On July 15th, 2022, to the United States Bankruptcy Court District of Connecticut, Miles Guo initiated a motion for relief from a court order appointing Luc A. Despins as his chapter 11 trustee. Based upon evidence discovered after his appointment that the Chapter 11 trustee, Luc A. Despins is not disinterested, therefore, it justifies vacating the approval of his appointment.

Luc A. Despins failed to disclose as part of his original declaration filed with the application a day before the hearing and then only disclosed verbally to Miles Guo’s prior counsel an hour before the hearing that his law firm, Paul Hastings, had represented multiple parties related to Miles’ largest creditor and zealous adversary, Pacific Alliance Asia Opportunity Fund (PAX). No appropriate vetting of this relationship and its’ purported termination in May of 2022, could have been conducted by anyone.

More significantly, Despins failed to disclose at any time his firm’s significant relationship with the People’s Republic of China, the Chinese Communist Party (“CCP”), and their state-owned and controlled entities. Despins is a long-term partner in Paul Hastings, with all the attendant fiduciary duties, and the co-chair of its Financial Restructuring group. As a matter of law, Paul Hastings’ legal relationships are Despins’ legal relationships. As a matter of fact, the People’s Republic of China and CCP are directly and fiercely adverse to Miles Guo, who is considered the CCP’s number one enemy in the world. In 2017, Miles Guo filed an application with the United States government for political asylum from the Chinese government. Miles Guo’s application for political asylum remains pending; his family, in multiple separate instances, was detained and tortured by the CCP.
