CCP’s National People’s Congress Passed ‘Emergency Legislation’ Process

According to media reports, on March 13th 2023, the CCP’s National People’s Congress (NPC) of the Chinese Communist Party (CCP) approved the passage of amendments to the Legislation Law. The amendment gives the 170 members of CCP’s NPC the special power to pass laws with just one deliberation. Previously, CCP legislation required three rounds of review, but there were exceptions. Three years ago, the National Security Law implemented in Hong Kong was passed only after one review by CCP’s NPC. Julian Ku, professor of constitutional law at Hofstra University in New York said the revised Legislation Law could be “abused and it is most likely that the laws will be forced through without consultation or publicity.” According to sources, CCP’s NPC began legislative reforms last Wednesday to shorten the time it takes to pass laws in an “emergency,” a move that observers see as preparations for the CCP’s military unification of Taiwan. A law that can quickly summon veterans to the battlefield is said to take effect this month. Legislation such as the National Defense Mobilization Law, which is being revised, will ensure that the CCP can assemble and redeploy personnel and resources as needed in wartime. The latest draft law, released on March 5th, does not define what constitutes an emergency, and the final text has not yet been made public. In principle, CCP’s NPC is the highest state authority of the CCP, and in fact it has been held by Xi Jinping’s ‘Xi Family Party’.
