Paul Hastings’ Conflict of Interest With Miles Guo – Stephen Wynn

As of August 1, 2022, EDT, the U.S. Bankruptcy Court for the District of Connecticut has denied Miles Guo’s motion for relief from the U.S. Trustee’s Office’s appointment of Luc A. Despinsthe as Chapter 11 trustee. Prior to the report, both Despins and his counsel, Paul Hastings LLP (“Paul Hastings”), ignored subpoenas issued by Miles’ counsel seeking discovery regarding their relationship with the government of the People’s Republic of China, the Communist Party of China.

Under U.S. Trust Law, a trustee’s conflict of interest occurs when the trustee’s personal interests potentially conflict with their duties to the trust beneficiaries. In his motion, Miles’ counsel cites numerous examples of Paul Hastings’ representation of CCP-owned enterprises and entities, all of which present significant conflicts of interest between Despins, Paul Hastings, and Miles.

In addition to the CCP-owned businesses and entities, Myers also mentioned other Paul Hastings’ representations to viewers in recent broadcasts, including those of U.S. casino mogul Stephen Wynn, which also presented a significant conflict of interest with himself.

According to an official news release issued by the U.S. Department of Justice on May 17, 2022, “The DOJ filed a civil enforcement action in the U.S. District Court for the District of Columbia, seeking to compel Stephen A. Wynn, a U.S. businessperson, and hotelier who previously served as the CEO of Wynn Resorts, to register under the Foreign Agents Registration Act (FARA) as the agent of the People’s Republic of China (PRC) and a senior official of the PRC’s Ministry of Public Security (MPS). Wynn was advised to register as an agent by the department but declined to do so.”; “According to the complaint, from at least June 2017 through August 2017, Wynn contacted the then-president and members of his administration to relay China’s request to cancel the visa or otherwise remove from the United States a Chinese businessman who left China in 2014 and was later accused by China of corruption and sought political asylum in the United States. Wynn was involved in these efforts at the request of then-Vice Minister of Public Security Sun Lijun.”
